Vendors and Purchasers must agree to the Terms and Conditions set out by Gold Muzzle Auctions (GMA) prior to nominating and authorising a Pup to be sold at the 2019 Gold Muzzle Auction and Purchasers must also agree and abide by the Terms and Conditions of a Registered Buyer at the 2019 Gold Muzzle Auction
GMA unequivocally reserves the right to refuse the Nomination of any Pup at their discretion and they may also refuse to register a Buyer at their discretion.

TERMS AND CONDITIONS OF SALE – 2019 GOLD MUZZLE AUCTION
RICHMOND RACETRACK – SUNDAY, JUNE 23, 2019
(1). Gold Muzzle Auctions (GMA).
(2). Pups must have been whelped between July 1, 2018 to January 31, 2019 inclusive to be eligible to be nominated for the 2019 Gold Muzzle Auction.
(3). Only greyhounds that have been purchased at the 2019 Gold Muzzle Auction and have had the respective Commission Fees; as well as the First and Second Nomination fees paid, will be eligible to nominate for the 2020 Golden Muzzle Race Series.
(4). There is a minimum prizemoney guarantee in place for the 2020 Golden Muzzle Race Series, which is underwritten and guaranteed by Greyhound Racing NSW (GRNSW)
(5). The 2020 Golden Muzzle Race Series to be staged at Wentworth Park in October 2020 over 520m will consist of Heats and a Final with Heats Prizemoney to be paid at the then current A1 Metropolitan 5th Grade Prizemoney class schedule (or its equivalent) irrespective of how many Heats are conducted
(6). The 2020 Golden Muzzle Race Series (Wentworth Park) Prizemoney allocation for the Final will be paid at the following rate;
1st - $40,000
2nd - $10,000
3rd - $3,000
4th to 8th - $500 each
Breeders Bonus - $1,000 paid to the Breeder of the Winner
(7). The 2020 Golden Muzzle Race Series to be staged at Richmond in November 2020 over 400m will consist of Heats and a Final with Heats Prizemoney to be paid at the then current TAB B Free-For-All class Prizemoney schedule (or its equivalent) irrespective of how many Heats are conducted
(8). The 2020 Golden Muzzle Race Series (Richmond) Prizemoney allocation for the Final will be paid at the following rate;
1st - $6,000
2nd - $2,000
3rd - $1,000
4th – 8th - $250 each
Breeders Bonus - $500 paid to the Breeder of the Winner
(9). GMA reserves the right to cancel the Auction should it appear likely to fail to meet reasonable commercial expectations.
(10). The first Auction nomination fee of $100 due (plus GST where applicable) is due and payable when the Nomination is lodged.
(11). On every lot sold, GMA shall deduct a payment of 11% of the final Sale Price as a Vendor Commission Fee
(12). There will be a minimum bid reserve price of $2,000 per lot with a minimum of $220 Vendor Commission Fee payable.
(13). Vendors are eligible to place a public Reserve Bid on their nominated lot/s.
(14). If the lot is not sold, the vendor must buy back the lot at the nominated Reserve Bid and pay the applicable Commission fees.
(15). Vendors may provide the Reserve Bid in writing by May 30, 2019.
(16). The second Auction nomination fee of $100 (plus GST where applicable) is payable by the current owner of the greyhound to GMA by April 1, 2020 to enable the eligibility of that greyhound to compete in the 2020 Golden Muzzle Race Series to be staged at Wentworth Park and Richmond.
(17). The highest bidder shall be the Purchaser, and should any dispute arise among the bidders for any lot, it shall be decided by the Auctioneer unless one of the disputants will advance, in which case, the lot or lots shall be put up again.
(18). This sale shall be conducted on an unreserved basis, and the highest bidder shall be the Purchaser. The decision of the Auctioneer shall be final in any disputes in bidding, and all bids are accepted on this basis only.
(19). The Auctioneer expressly reserves the right to refuse any bid without indicating grounds or reasons thereof.
(20). The Auctioneer reserves the right, without giving any reason thereof, to withdraw any lots before or during the sale.
(21). Prior to the Auction, the Auctioneer needs to be informed if the vendor is GST registered or not. Sales will only be subject to GST if the vendor is registered for GST.
(22). Each lot is sold with all faults, if any. Upon the fall of the hammer all responsibility for expenses, injury, forwarding instructions etc become that of the purchaser.
(23). Each lot shall be at the risk of the vendor in respect of any damage or injury, whether by disease, accident or otherwise, or whether caused by negligence of the Auctioneer, unless such lots have been sold, in the latter case such lot shall be at the risk of the Purchaser I all such respects from the acceptance of his bid or offer by the vendor.
(24). PAYMENT – the full purchase money for each lot shall be due and payable to Gold Muzzle Auctions (GMA) on the fall of the hammer and prior to delivery.
(25). Except at the direction of GMA, no lot shall be delivered to the Purchaser unless payment of the purchase money together with any additional charges incurred is made by the Purchaser to GMA.
(26). Property in the lot sold shall only pass on the payment of the purchase money in full not withstanding delivery of the forbearance by the Auctioneer to require payment to be made by the Purchaser in terms of these conditions prior to delivery.
(27). Should the purchaser neglect or fail to comply with any of the above conditions, any stock purchased by him may be immediately resold by public auction or private contract, with or without notice, at the risk of the former purchaser, who will be responsible for all loss and
expenses arising out of such a resale, and shall not participate in any profit accruing therefrom.
(28). From the fall of the hammer the Purchaser shall be responsible for all the expenses of the care of the lot and all losses and expenses occasioned by the death or illness of or accident to the lot and shall hold GMA, Auctioneer and Vendor indemnified against any such expenses and losses.
(29). Excepting the conditions and warranties implied by the Trade Practices Act or any applicable State Legislation which cannot be contractually excluded no guarantee or warranty shall be given with any stock unless sold under these conditions as to pedigree, sex, age conditions or otherwise how so ever, nor shall any guarantee be implied from any affirmation made at the time of sale, or from any circumstances of the sale, but in all cases where a guarantee is intended the same shall attach and be enforced only if reduced to writing before delivery of the stock and signed by the Vendor, and the absence of such writing shall be conclusive evidence in case of dispute that no guarantee or warranty was given or implied.
(30). The Auctioneer is to be considered the Agent merely between Vendor and Purchaser, and in all disputes arising from defect of title, wrong description, pedigree, warranty or otherwise, the Purchaser and Vendor must adjust the matter between themselves, and no lot
is to be returned to the Auctioneer.
(31). The Auctioneer shall be under no liability for the loss, if any incurred by the Vendor by reason of the failure on the part of the Purchaser to complete his purchase. The name, description and address given by the Vendor will in all cases be furnished to the Purchaser if
required, and in the case of any dispute the remedy of the Buyer shall be against such Vendor only and in case or under any circumstances against the Auctioneer, who is to be regarded for all intents and purposes as Agents for a disclosed principal.
(32). The description, either as to quality, pedigree, engagements or otherwise for any lot offered is supplied by the Vendor who alone is responsible for its accuracy and the Auctioneer shall not be liable for any error is such description.
(33). The purchasers, if more than one, shall be jointly and severally bound by these terms and conditions and shall jointly and severally carry out and perform the same.
(34). Any person who advances a bid on the lot shall do so on the express condition and understanding that should that person’s bid be the highest bid and such bid accepted by the vendor then that person will be held personally liable for the price so agreed upon, regardless
of the fact that they may be acting on behalf of another party, either disclosed or undisclosed to the vendor or his agents, provided however, that this condition shall not in any way negate the Vendor’s right to claim against any principal and in such case the Bidders liability shall be
constructed to be by way of guarantee.
(35). On the fall of the hammer the Purchaser shall give his name and address to a representative of the Auctioneer. Total payment must be made to GMA before delivery can be arranged. If the Purchaser fails to comply with any of these conditions the lot or lots in respect of which such failure is made may, if the Auctioneer thinks fit, be put up again and resold. If upon such resale a lower price is obtained for any such lots than was obtained upon the first sale the difference in price shall be a debt due from the Purchaser in default upon the first sale.
(36). It is the responsibility of the Purchaser to acquaint themselves with the nomination process of the Gold Muzzle Auction 2020 Golden Muzzle Race Series. The number of heats will be determined according to the total number of nominations received. The maximum
number of heats comprising full fields of eight will be drawn (where possible) according to the provisions of the GRNSW TAB Grading Policy Order of Entry, with reserves allocated, where applicable, according to the order of entry.
